HOWARD STERN SHOW “COUGAR BEAUTY PAGEANT” CONTEST
The Howard Stern Show and CougarLife.com are looking for “cougars” to compete for a $5,000 prize in the Howard Stern Show “Cougar Beauty Pageant”. If you’re a sexy biological female in your PRIME from 35 to 50 years of age (a “cougar”), send us your stuff!

HOW TO ENTER. YOU MUST BE A BIOLOGICAL FEMALE FROM THE AGE OF 35 TO 50, INCLUSIVE, (A “COUGAR”) TO ENTER. To enter, submit one (1) recent clear photo of yourself, alone, showing both your face (head fully shown) and body, without alteration (or editing), taken within the last year, along with an email containing the following information: one contestant’s full name, date of birth, and contact phone numbers (day and night) (an “Entry”). Entries should be emailed to the following email address: contest@howardstern.com from 12:01 a.m. eastern time (“ET”) on October 26, 2009 to noon ET on November 19, 2009 (the "Entry Period"). You can only enter this contest by e-mail. Photos must be attached to the email Entry as a jpeg file and must be 72 DPI, no smaller than 400 pixels width and height. Entries must be submitted personally by the individual depicted in the photo. Entries that are incomplete or corrupted are void and will not be eligible. Limit one Entry per person. Proof of submission will not be deemed to be proof of receipt. All entries and requests become the property of Sponsor and will not be acknowledged or returned. Multiple entries submitted by a single person during the Entry Period using the same e-mail address are void. In the event of a dispute over the identity of the entrant, Entry will be deemed submitted by the authorized account holder of the e-mail account of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
CONDITIONS OF ENTRY / ELIGIBILITY TO WIN. This contest is open to legal residents of the U.S.A. or the District of Columbia who are at least 21 years of age, who are biological females from the ages of 35 to 50, inclusive. This contest is intended for play in the United States only and shall only be construed and evaluated according to United States law. Do not enter this contest if you are not located in the United States. By participating in the contest (i) You agree to be bound by these Official Rules, including all eligibility requirements, (ii) You agree to be bound by the decisions of Sponsor and its judging organization, which are final and binding in all matters, (iii) You agree that your contest Entry submission is not misappropriated, depicts you personally, and will not infringe any third party’s copyright, patent, trademark, or trade secret, or violate any third party’s right of privacy, or entail libel or defamation, (iv) You agree that you have personally submitted the photo and email containing the Entry, and all that this entry and possible winning status will entail, and have agreed to enter, and (v) IF CHOSEN AS A POTENTIAL FINALIST, you will be willing, and try to be able, to travel to New York, New York on the dates Sponsor needs you to be present for final judging. Employees of Sponsor, Cougar Life Inc., HOH Limited, PV Blacktie SL, Spain, iN DEMAND, LLC,, 112 Inc., The Howard Stern Show and Howard Stern Channels (collectively, “HS ENTITIES”) or their respective subsidiaries, affiliates, advertising and promotion agencies, retailers or distributors, and members of their immediate family (e.g., spouses, parents, children, siblings, grandparents) or household (i.e., people who share the same residence at least 3 months a year (whether related or not), and those with home such employee is domiciled, are not eligible to win. Entries that are incomplete or corrupted are void and will not be eligible. Any effort by a contestant to misrepresent herself, or any individual, through the use of aliases or multiple e-mail addresses will disqualify all entries of such individual. Sponsor and its agents reserve the right to verify eligibility qualifications of any winner. Failure to comply with these Official Rules may result in disqualification from the contest. This contest is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law.
SPECIAL PUBLICITY NOTICE. By entering this contest you grant to Sponsor and Cougar Life Inc. your express permission (except where prohibited by law) to use all elements of your participation on the radio or television for entertainment purposes (without identifying you by full name but including your hometown), without further compensation. Also, by entering this contest, if you are selected as a finalist or a winner, you grant to Sponsor and Cougar Life Inc. your express permission (except where prohibited by law) to use your name, identity, description of prize won, hometown and likeness, if applicable, for promotional purposes, in any media now known or hereafter developed, including on the radio, and including for “live notification” of potential winner status purposes, without further compensation. Even though you consent to all of the above, Sponsor has no obligation to do any of it. See more details at “Winner / Agreements” below. If you don’t want your friends and family to know you’re a fan, don’t enter this contest.
PRIZE. One (1) Grand Prize will be awarded in the amount of $5,000 (in the form of a company check). Grand Prize is non-transferable. In no event shall more than the number of stated prizes be awarded. All prizes will be awarded. All federal, state, local and other taxes, costs and expenses relating to the use, acceptance and possession of the prize are the sole responsibility of the winner. Grand Prize winner will receive an IRS Form 1099 from Sponsor for the value of the Grand Prize.
ODDS. Odds of winning depend upon the number of eligible Entries received during the Entry Period. This contest is being advertised on the radio on the Howard Stern Channels on SIRIUS Radio 100 and 101 and XM Radio 100 and 101 (as part of the Best of SIRIUS package), and on the internet at www.sirius.com/howardstern and www.xmradio.com/onxm/channelpage.xmc?ch=101.
JUDGING. All Entries will be judged by a panel of judges, made up of producers and staff of the HS Entities and on-air talent (the “Judges”), who will select up to five (5) finalists (each, a “Potential Finalist”) from among all eligible Entries received during the Entry Period, based on the photo submitted with their Entry, using the following criteria (on a hundred point scale): 50% beauty, 35% style, and 15% perceived sexual allure. The actual number of Potential Finalists may vary depending upon the number and quality of qualified Entries. On the first tier of judging, a tie will be broken based upon the highest score in the beauty category. If a further tie exists, such tie will be broken by a re-judging of the tied entries on the second tier of judging, based on perceived sexual allure. Potential Finalists will be selected by December 3, 2009. The Potential Grand Prize Winner will be judged from among all Potential Finalists by one or more individuals from the panel of Judges in person, at a taping of the Show (defined below), on or about December 16, 2009. All pronouncements of Potential Finalist status will be awarded as long as there are a sufficient number of eligible Entries. The decisions of the judges shall be final and binding on all matters relating to this contest.
REQUIRED AGREEMENTS OF POTENTIAL FINALISTS. If you are chosen as a Potential Finalist, you will be notified by telephone and must then give a monitored e-mail address, to be used for the purpose of sending a package containing a notification of potential winner status and required documents. Potential Finalists will each be required to sign an Affidavit of Eligibility, Publicity & Liability Release (“Release”), within two days of the date of notification on the Release which will require verification of social security number for tax purposes prior to participating in the second tier of judging. Except where prohibited, acceptance of status as a Potential Finalist constitutes each entrant’s consent to allow Sponsor and its promotional agents to use the entrant’s name, likeness, photo, video footage, and/or biographical data for advertising and promotional purposes, without additional compensation, in perpetuity, in all media, now known or hereafter developed, in connection with Sponsor, this contest, the Sponsor’s web sites, and the Show. Ultimate winner will be required to sign and return to Sponsor an IRS Form W-9 (if required by IRS regulations), prior to and as a condition of acceptance of prize, within 5 days of notification of Grand Prize winner status or prize will be forfeited and an alternate winner selected.
In addition, Potential Finalists must be able to travel to New York, New York on December 16, 2009 (date subject to change) for an in-studio segment taping where each Potential Finalist will be interviewed and reviewed by Howard Stern and other show principals (“Show”) or will forfeit her rights to compete further. At the end of the Show segment, Howard Stern will choose the Grand Prize Winner entry based on his preference and liking. Only one Grand Prize Winner will be chosen and the final decision will be made by Howard Stern. The Release will grant rights to use the Potential Finalists’ appearance on the Show in any and all media, including without limitation, radio and television. If any Potential Finalist does not respond to the telephone notification within 24 hours, is found to be ineligible, fails to execute any documentation required by Sponsor within the required period, or cannot travel to New York, New York or attend the Show on the scheduled date, the selected Potential Finalist will forfeit the right to be a Potential Finalist and another runner up will be selected as time allows. SPONSOR reserves the right to modify notification procedures, in its sole discretion, if necessary due to time constraints.
Sponsor will provide each Potential Finalist with round-trip coach air transportation to New York, New York (the "Destination") from a major commercial airport located near the Potential Finalist’s primary residence (as determined by Sponsor); provided that Sponsor reserves the right to substitute ground transportation for air transportation if the Potential Finalist resides within 150 miles of the Destination. Travel provided shall not be deemed part of the Prize but part of production costs of the Show. All other expenses not mentioned herein, including without limitation, ground transportation, meals, hotel amenities, fees and gratuities, are the responsibility of the Potential Finalist. In the event that Sponsor elects to provide hotel accommodations in connection with travel for any Show, such accommodations shall include a standard room and the tax thereon only and shall not be deemed part of the Prize but part of production costs of the show. All prizes will be awarded within 60 days after receipt and verification of completed prize notification. If prize notification is undeliverable, or the entrant cannot be contacted for any reason during the time Sponsor must make contact, or in the event of non-compliance with these Official Rules, the prize will be forfeited, and an alternate winner will be selected at random from the remaining eligible entries.
PRIVACY NOTICE / MARKETING. By entering this contest, any personal information you submit will be disclosed to the Sponsor (Sirius XM Radio Inc.) and Paramount Pictures Corporation and will be used only by us consistent with our privacy policies. Sponsor may use your personal information, including postal and e-mail addresses, to contact them regarding our goods and services and any other offers and/or promotions that we believe might interest to them. GENERAL CAUTION / RELEASE. Sponsor reserves the right to permanently disqualify any person it believes has intentionally violated these Official Rules. ENTRIES MUST BE SUBMITTED PERSONALLY BY THE ENTRANT DEPICTED IN THE PHOTO, AND SPONSOR SHALL HAVE NO LIABILITY WHATSOEVER IN THE EVENT OF THIRD-PARTY ENTRY SUBMISSIONS. If, in the judges’ opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of this contest, or if technical difficulties or technical corruption (including a computer virus or system malfunction) compromise the integrity of the contest, the judges reserve the right to terminate the contest and select winners from among all eligible entries received prior to termination. Should the contest be terminated prior to the stated expiration date, notice will be posted at www.sirius.com/howardstern. Any attempt to deliberately damage the content or operation of this contest is unlawful and subject to legal action by the Sponsor and its agents. Judges’ decisions are final in all matters relating to this contest. You agree, on your own behalf, and on behalf of your heirs, executors, administrators, legal representatives, successors and assigns (“RELEASING PARTIES”), hereby release, and agree to defend, indemnify, and hold harmless the Sponsor, Cougar Life Inc., those working on their respective behalves, and all other businesses involved in this contest, as well as each of their respective employees, officers, directors, agents and representatives, successors and assigns (“RELEASED PARTIES”), from any and all actions, causes of action, suits, debts, dues, sums of money, accounts, reckonings, covenants, contracts, controversies, agreements, promises, trespasses, lost profits, indirect or direct damages, consequential damages, incidental damages, punitive or exemplary damages, including for injury and death, judgments, extent, executions, claims and demands whatsoever, in law, admiralty or equity, whether known or unknown, foreseen or unforeseen, against RELEASED PARTIES which any one or more of the RELEASING PARTIES ever had, now have or hereafter can, shall or may have, whether known or unknown, asserted or non-asserted, which may in any way arise out of or relate to your participation in this contest or the awarding, acceptance and use or misuse of a prize.
DISCLAIMER OF LIABILITY. Sponsor shall not be responsible for (i) any typographical or other error in the publishing or printing of the offer, administration of the contest or in the announcement of any prize; (ii) lost, late, misdirected, damaged, illegible or incomplete entries, or postage due mail; (iii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; (iv) any injury or damage to contestant’s or any other person’s computer related to or resulting from participating in the contest; or (v) the failure of any third party to comply with the instructions and proper administration of this contest. You agree that the RELEASED PARTIES (defined above) shall not be liable for any injury, including death, loss or damage of any kind caused or claimed to be caused, by participation in this contest, or from the acceptance or use or redemption of any prize, including travel and accommodations provided by independent suppliers. In the event Sponsor and its agents are prevented from continuing with the contest as contemplated herein by any event beyond its control, including but not limited to fire, flood, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state, or local government law, order, or regulation, or order of any court or other cause not within their control, Sponsor and its agents shall have the right to modify, suspend, extend or terminate the contest.
LAW / DISPUTE RESOLUTION. This contest shall be governed by and interpreted under the laws of the State of New York, U.S.A., without regard to its conflicts of laws provisions that may require the application of the laws of another jurisdiction. Any and all disputes, claims, and causes of action arising out of or in connection with this contest shall be resolved individually, without resort to any form of class action. Any action or litigation concerning this contest shall take place exclusively in the federal or state courts sitting in New York, New York, and you expressly consent to the jurisdiction of and venue in such courts and you waive all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. You agree to service of process by mail or other method acceptable under the laws of the State of New York. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS CONTEST. YOU HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.
